Terms of Service

These Terms of Service govern your use of the Wearsper mobile application and website (the "Service"), operated by Wearsper Ltd, a company registered in England and Wales under company number 17400697. By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. What Wearsper is

Wearsper lets you catalogue clothing you own, receive AI-generated outfit recommendations from your own wardrobe, and generate AI images of outfits, including a photoshoot-style rendering of an outfit and a virtual try-on feature showing you wearing your own clothes.

2. Your account

You must be at least 16 years old to use Wearsper. You're responsible for keeping your login credentials secure, and for all activity that happens under your account. If you believe your account has been compromised, contact us immediately at admin@wearsper.com.

3. Subscriptions and billing

Wearsper offers the following tiers. Prices and included allowances may change from time to time, if they do, we'll make the current pricing clear in the app before you're charged anything different.

Paid subscriptions automatically renew each month unless you cancel before the renewal date. You can manage or cancel your subscription at any time from within the app. Cancelling stops future charges but doesn't refund the current billing period, except where required by law.

Payments are processed securely by Stripe. We never see or store your full card details.

4. Acceptable use

You agree to only upload photos of yourself, or of others with their clear consent, for the virtual try-on feature. Uploading someone else's photo without their permission is a violation of these Terms and may violate their own legal rights.

You also agree to only upload clothing photos you have the right to photograph and use, not to use Wearsper to generate misleading, harmful, or offensive imagery, and not to attempt to disrupt, reverse-engineer, or abuse the Service in a way that circumvents fair usage of your subscription tier.

We reserve the right to suspend or terminate accounts that violate these terms.

5. AI-generated content

Wearsper uses AI throughout the app, from automatically classifying your wardrobe items to generating outfit images. AI can make mistakes. A garment might be misclassified, a colour might not perfectly match, and a generated image is an approximation, not a guaranteed accurate representation. We give you tools to review and manually correct these where possible, and we encourage you to double-check results before relying on them.

6. Your content, and our content

Your photos remain yours. By uploading a photo, you grant us a limited licence to process, store, and display it back to you as part of providing the Service. We don't use your personal photos for any purpose beyond operating Wearsper for you, and we don't claim ownership of them.

The Wearsper app, brand, and underlying technology are our intellectual property, and these Terms don't grant you any rights to them beyond normal use of the Service.

7. Disclaimers

The Service is provided "as is." We aim for it to be reliable and accurate, but we don't guarantee that outfit recommendations, garment classifications, or AI-generated images will always be correct, or that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, Wearsper Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits any liability that cannot legally be excluded, including for death or personal injury caused by our negligence, or for fraud.

9. Ending your account

You can delete your account at any time directly within the app. This permanently removes your data from our systems, as described in our Privacy Policy. We may also suspend or terminate your account if you seriously or repeatedly breach these Terms.

10. Changes to these Terms

We may update these Terms from time to time. We'll update the date at the top of this page, and for significant changes, we'll make reasonable efforts to notify you before they take effect.

11. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
